Document purpose: to provide a clear, fair and scalable legal foundation for TCC services while preserving service-specific terms where the nature of a programme or service requires different rules.
IMPORTANT - These General Terms apply together with the Programme Terms, Service Terms, Participation Terms or other specific terms presented for the relevant TCC offering. Service-specific terms prevail only for the subject matter they expressly address.
1. About These Terms
These General Terms of Service govern the common terms applicable to services and educational activities offered under The Currency Club ("TCC"), operated by IKEN Training and Development Services.
Specific programmes and services may have additional Programme Terms, Service Terms, Participation Terms, Digital Resource Terms or disclosures. Those documents form part of the agreement for the relevant service.
2. Document Hierarchy
If a service-specific document expressly provides a different rule for a particular service, that specific rule applies to that service and subject matter. These General Terms continue to apply to all matters not specifically varied.
The TCC Privacy Notice and Complaints & Customer Support Policy operate alongside these Terms. Trading-risk and educational-use provisions are contained within these General Terms so participants do not have to rely on a separate duplicate risk document.
3. Eligibility and Accurate Information
Unless TCC expressly states otherwise for a particular service, participation in trading-related programmes and services is limited to persons 18 years old or older. Participants must provide accurate and reasonably complete information and must not impersonate another person or misuse another person's details.
4. Educational Nature of TCC Services
TCC provides trader-development, financial-market education and related educational services. Content may discuss trading processes, technical or fundamental analysis, market data, risk, behaviour, routines, examples, market commentary and other learning material.
TCC educational content is not a promise of profitability, financial return or investment performance. General educational content is not personalised investment, financial, legal or tax advice.
5. No Custody, Account Management or Trade Execution
Unless TCC later establishes a separate lawfully authorised and separately documented service, TCC does not accept money for investment, take custody of trading capital, manage participant trading accounts, execute trades for participants, provide managed accounts or copy trading, or guarantee trading results.
Any personal trading account is opened, funded and controlled by the participant. Trading decisions and financial consequences remain the participant's responsibility.
6. Service Description and Confirmation
TCC will describe the material features of a paid service before purchase, including the applicable price, format, principal inclusions and any important service-specific conditions. Registration, booking or enrolment becomes confirmed when TCC communicates confirmation and, where applicable, verifies payment.
A registration request does not guarantee capacity unless TCC has expressly confirmed the participant's place.
7. Fees, Payments and No Store of Value
Fees paid to TCC are consideration for the educational or related service purchased. They are not deposits, savings, investments or trading capital and are not held for investment on the participant's behalf.
Where payment is required, the applicable price and payment method will be disclosed before the transaction is completed. TCC will provide the appropriate transaction document required for the applicable sale or service.
8. Cancellations, Cooling-Off Periods, Transfers and Refunds
Cancellation, cooling-off, transfer and refund rules may differ between services because TCC services have different delivery models, preparation requirements and resource commitments. The applicable rules will therefore be stated in the relevant service-specific terms before the participant commits to a paid service.
A service-specific policy does not remove any consumer right or remedy that cannot lawfully be excluded. Where TCC fails to provide the contracted service, materially misrepresents it, or applicable law otherwise requires a remedy, TCC will provide an appropriate remedy having regard to the circumstances and mandatory rights.
9. Complimentary Services
TCC may offer complimentary webinars, sessions, resources, campaigns or programme access. Complimentary access applies only to the relevant offer, is subject to capacity and applicable participation terms, and does not create an entitlement to future complimentary access. No monetary refund arises where no programme or service fee was paid.
10. Participant Responsibilities
- participate honestly and respectfully;
- follow reasonable programme, safety and technology instructions;
- protect account credentials and private access links;
- make independent decisions about trading or financial activity;
- avoid sharing passwords, restricted links or protected programme materials;
- avoid conduct that materially disrupts another participant's learning, privacy or safety.
11. Trading Risk and Educational Use
Trading financial markets involves risk and losses are possible. Prices can move rapidly and unexpectedly, and no trading strategy, framework, educator, indicator, analysis technique or risk-management method can guarantee profitability.
Leverage can magnify gains and losses. Participants should understand margin, position sizing, volatility and account exposure before using leveraged products.
Technical analysis, fundamental analysis, market data and other information may assist decision-making but cannot establish future market outcomes with certainty.
Historical, hypothetical or simulated examples do not guarantee future results. Historical examples may benefit from hindsight, while simulated results may not reflect live factors such as slippage, liquidity, spreads, execution conditions or psychological pressure.
Risk-management methods can structure or reduce certain forms of exposure but cannot eliminate market risk. Stop-loss orders and similar controls may not always execute at the requested price in fast or illiquid conditions.
Any decision to enter or exit a trade, select an instrument, determine position size, use leverage, select a broker, fund an account, determine a stop loss, establish a target or otherwise participate in a market remains the participant's responsibility.
TCC may use or encourage demo or simulated environments for educational practice. If a participant independently chooses to use a personal funded account, the financial consequences remain their responsibility.
Payment for TCC education purchases access to the educational service described. It does not purchase or guarantee a trading result.
Statements concerning skill development, process, discipline, competence or education must not be interpreted as earnings or profitability promises.
General educational material does not account for every participant's financial circumstances, objectives, experience, risk tolerance, debts, income or tax position. Professional advice should be obtained where appropriate.
12. Daily Market Bias and Market Commentary
TCC may publish Daily Market Bias and other educational market commentary. Such material may describe market context, directional bias, significant levels and educational scenarios. It is general educational commentary and is not intended as a personalised instruction to buy, sell, enter, exit, size or manage a specific trade.
A bullish, bearish or neutral assessment does not instruct a person to place a trade. Market conditions may change after publication. A market view is not a guarantee and a bias is not a trade.
13. Intellectual Property and Personal Use Licence
Original TCC programme structures, branded frameworks, presentations, diagrams, exercises, worksheets, videos, written material, graphics, recordings and other protected content belong to TCC / IKEN Training and Development Services or are used with permission.
Unless TCC expressly provides otherwise, access is granted for the participant's personal educational use only. Participants must not reproduce substantial content, commercially redistribute it, resell it, publish protected screenshots, remove ownership notices, provide access to unauthorised persons, or present TCC intellectual property as their own.
14. Recording, Screen Capture and Event Content
Participants must not record, screen-record, systematically capture, reproduce or redistribute restricted TCC session content, teaching materials or private programme communications unless TCC expressly authorises it.
Where TCC records a session or captures identifiable participant audio, video or images, TCC will provide appropriate notice and will process personal data for the stated purpose in accordance with the TCC Privacy Notice and applicable data-protection requirements. Operational recording, attendance records and marketing use are not treated as automatically interchangeable purposes.
15. Participant Contributions
Participants retain ownership of their own original contributions, subject to rights they expressly grant or permissions reasonably necessary to operate the service. TCC does not claim blanket ownership of a participant's personal notes, questions or original ideas merely because they are shared during a programme.
Participants must not submit material that unlawfully infringes another person's rights or discloses confidential information they are not authorised to share.
16. Privacy and Data Handling
TCC processes personal information in accordance with the TCC Privacy Notice. Personal data must be collected for declared, specified and legitimate purposes and should be adequate, relevant and proportionate to those purposes.
Necessary service communications are separate from optional marketing. Where consent is relied upon for marketing or another processing purpose, it will be handled separately from consent or acceptance required to administer the service.
17. Brokerage Independence and Brokerage Selection
TCC is not a brokerage, introducing broker or broker client-acquisition channel. TCC does not open brokerage accounts for participants, place trades through a brokerage on a participant's behalf, or receive brokerage commissions, trading rebates or referral payments for directing participants to a brokerage.
TCC may teach participants how to assess or qualify a brokerage based on their own needs, including considerations such as regulation, product access, platform features, costs, execution arrangements, account requirements and support. Any brokerage selection, application and account-opening decision remains the participant's independent decision. TCC educational discussion of brokerage-selection criteria does not constitute an endorsement or instruction to use a particular brokerage.
18. TCC Marketing Partner Programme
TCC may operate a Marketing Partner Programme through which members of the community or approved partners may refer prospective participants to TCC programmes or services and may receive a reward where the applicable referral conditions are satisfied and the referred person makes a qualifying purchase from TCC.
This Marketing Partner Programme relates only to referrals into TCC educational programmes and services. It does not include brokerage referrals, brokerage rebates, trading-volume rebates or compensation from a brokerage. Marketing partners are not authorised to present TCC as a brokerage, promise trading results, or provide regulated financial services on TCC's behalf.
19. Operational Service Providers and Data Sharing
TCC may use third-party operational service providers and systems, such as customer relationship management (CRM), learning management (LMS), website, communications and other internal business tools, where reasonably necessary to administer the client journey and deliver TCC services.
TCC does not sell, provide or transfer participant personal information to brokerages for broker marketing, client acquisition, account opening or trading-related solicitation. Personal information handled by TCC is processed in accordance with the TCC Privacy Notice and the applicable arrangements with TCC's operational service providers.
20. Independent Brokerage Websites and Data Collection
If a participant independently visits a brokerage website, application page or registration page, any personal information the participant provides directly to that brokerage is collected by the brokerage under its own terms, privacy notice and regulatory arrangements. TCC does not control that independent collection merely because the participant learned about brokerage-selection considerations through TCC education.
Participants should review a brokerage's own legal, privacy and regulatory information before submitting personal information or opening an account.
21. Technology and Availability
TCC will make reasonable efforts to provide its online services as described, but cannot guarantee uninterrupted availability of participant devices, internet connections or unrelated third-party infrastructure. Where a disruption materially prevents delivery of a paid service, the applicable service-specific remedy provisions will apply.
22. Reasonable Changes to Services
TCC may make reasonable operational changes that do not materially remove the core service purchased, including changes to sequencing, examples, supporting resources, facilitator assignment or technology. Material changes that prevent a participant from reasonably receiving the purchased service will be addressed under the applicable service-specific terms and mandatory consumer rights.
23. Conduct, Suspension and Removal
TCC may warn, restrict or remove a participant for serious or repeated misconduct, including harassment, fraud, security abuse, unauthorised recording or redistribution, material disruption, misuse of another participant's personal data, or substantial infringement of TCC intellectual property. TCC will consider proportionality and the circumstances where reasonably practicable.
Removal for misconduct does not automatically remove any consumer right that cannot lawfully be excluded.
24. Complaints and Internal Redress
TCC maintains an accessible Complaints & Customer Support process. Participants should first raise service complaints through TCC's internal redress mechanism. TCC will handle complaints in accordance with its published Complaints & Customer Support Policy and applicable Philippine law.
Using TCC's internal process does not remove external rights or remedies that remain available under law.
25. Electronic Acceptance and Records
TCC terms, acknowledgements, registrations and related agreements may be accepted electronically. TCC may retain records reasonably necessary to evidence the applicable terms, version identifiers, date and time, service or cohort identifier, acknowledgement state, payment or transaction status where relevant, and optional marketing preference.
26. Limitation of Responsibility
To the extent permitted by applicable law, TCC is not responsible for trading losses or financial outcomes resulting from a participant's independently made decisions. TCC does not guarantee profitability, permanent behaviour change, successful completion, qualification, employment, accreditation or any other outcome unless expressly stated in the applicable service description.
Nothing in these Terms excludes or restricts any right, remedy or liability that cannot lawfully be excluded or restricted under Philippine law.
27. Events Beyond Reasonable Control
TCC will not be responsible for delay or interruption caused by circumstances reasonably beyond its control, including natural disasters, widespread power or internet failures, government action, public emergencies or serious failure of critical third-party infrastructure. TCC will make reasonable efforts to reschedule, continue or provide an appropriate alternative where a paid service is materially affected.
28. Changes to These General Terms
TCC may update these General Terms when its services, operating model or legal obligations change. The current version and effective date will remain identifiable. A material change will not retrospectively remove rights already accrued under an existing transaction unless permitted by law.
29. Governing Law
These General Terms are governed by the laws of the Republic of the Philippines.

31. Legal Architecture Note
These General Terms are designed to operate together with service-specific terms. They are not intended to classify TCC as a regulated financial-service provider or to replace any licence, registration or authorisation that might become necessary if TCC later changes the substance of its activities.
